How StreetLink works — and what we expect.
These Terms apply when you use StreetLink. The short version: drive safely, treat people well, and don't break things.
Acceptance of These Terms
These Terms of Service (“Terms”) are a binding legal agreement between you and Maxwell Collective Co, which operates StreetLink (“StreetLink,” “we,” “us,” or “our”). They govern your use of the StreetLink mobile app, getstreetlink.com, and related services (the “Service”). By creating an account, tapping to accept, or using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines, all incorporated by reference. If you do not agree, do not use the Service. PLEASE READ THE DRIVING-SAFETY, ASSUMPTION-OF-RISK, DISCLAIMER, LIMITATION-OF-LIABILITY, AND ARBITRATION SECTIONS CAREFULLY — THEY AFFECT YOUR LEGAL RIGHTS.
Eligibility and Age
You must be at least 17 years old and able to form a legally binding contract to use StreetLink. Any feature involving a vehicle is intended only for individuals operating a vehicle lawfully—properly licensed, registered, and insured—or for passengers. You represent that you meet these requirements and that all information you provide is accurate. You are responsible for complying with all laws that apply to you, including licensing, registration, insurance, equipment, and traffic laws.
What StreetLink Is — and Is Not
StreetLink is a social and community application that lets enthusiasts log and share drives, connect with a crew, view leaderboards, communicate, and buy and sell in a marketplace. StreetLink is a consumer social product for entertainment and community. It is NOT a professional navigation system, a driver-assistance or safety system, a telematics or emergency service, or a substitute for your own attention, judgment, or lawful conduct. Features, availability, and data may change, be delayed, be inaccurate, or be unavailable at any time.
Driving Safety — Please Read
Your safety and the safety of others always comes first. DO NOT hold, look at, tap, type on, or otherwise interact with your phone or StreetLink while operating a vehicle. Set up your drive before you move, mount your device, and use only hands-free and voice features, and only where permitted by law. Never let the app distract you. Obey all speed limits, traffic signals, and laws, and adjust to road, weather, and traffic conditions. You are solely and fully responsible for operating your vehicle safely, lawfully, and attentively at all times. Passengers, not drivers, should handle any interaction that requires looking at the screen.
No Racing, Speeding, Reckless or Illegal Driving
StreetLink does not permit, encourage, sponsor, or facilitate street racing, speed contests, ‘takeovers,’ stunting, evading law enforcement, or any reckless, distracted, impaired, or unlawful operation of a vehicle. Statistics such as speed, distance, top speed, and leaderboard standings are provided solely for personal record-keeping and community enjoyment—they are not a challenge, inducement, encouragement, competition, or reward to exceed speed limits, race, or drive unsafely, and you agree not to treat them as such. Using the Service to plan, promote, coordinate, glorify, or engage in illegal or unsafe driving is a serious violation of these Terms and may result in immediate termination and, where appropriate, referral to law enforcement.
Assumption of Risk; Release; Covenant Not to Sue
You understand and agree that driving, riding, attending car meets and events, meeting other users in person, and completing marketplace transactions involve inherent and significant risks, including the risk of traffic collisions, mechanical failure, property damage, financial loss, physical injury, disability, and death, to you and others. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL SUCH RISKS, and you release, waive, and discharge Maxwell Collective Co, StreetLink, and their owners, members, officers, employees, contractors, and providers (the “Released Parties”) from, and covenant not to sue them for, any and all claims, liabilities, demands, damages, losses, costs, and expenses of any kind arising out of or relating to your driving or riding, your use of driving, location, mapping, or communication features, your attendance at events, your interactions or transactions with other users, or the conduct of other users—whether based on negligence or any other theory—except to the extent a loss is finally determined to have been caused by the Released Parties’ own gross negligence or willful misconduct or where such a release is prohibited by law.
Data and Feature Accuracy
Location, GPS, speed, heading, distance, route, ETA, leaderboard, and other data are generated by device sensors and third-party services and may be inaccurate, incomplete, delayed, or unavailable. We do not warrant the accuracy, reliability, timeliness, or completeness of any data or feature, and you agree not to rely on them for any purpose where accuracy is important.
Your Account
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Provide accurate information, keep it current, and promptly notify us of any unauthorized use or security breach. You may not share, sell, rent, or transfer your account, create an account for anyone else without authorization, or use another user’s account.
Your Content and License
You retain ownership of the content you submit—profile details, messages, listings, photos, drive data, and posts (“User Content”). By submitting User Content you grant StreetLink a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, cache, reproduce, adapt (for formatting and display), publish, display, and distribute that User Content solely to operate, provide, promote, and improve the Service. This license ends when you delete your User Content or account, except for content already shared with others, retained in backups for a limited period, or that must be retained by law. You are solely responsible for your User Content.
Your Representations and Warranties
You represent and warrant that: you have all rights necessary to submit your User Content and to grant the license above; your User Content and conduct do not violate any law or any third party’s rights (including intellectual-property, privacy, and publicity rights); the information you provide is accurate; and you will use the Service only for lawful purposes and in accordance with these Terms.
Community Guidelines and Prohibited Conduct
StreetLink has zero tolerance for objectionable content and abusive behavior. You may not, and may not allow others to: post or transmit content that is illegal, harassing, threatening, defamatory, hateful, violent, sexually explicit, or that exploits or endangers minors; infringe intellectual-property or other rights; impersonate any person or entity; spam, scam, phish, or defraud; promote or facilitate unsafe, reckless, or unlawful driving; sell illegal, stolen, counterfeit, recalled, or regulated items in the Marketplace; harass, stalk, or threaten other users; abuse or manipulate reporting, leaderboards, or other features; collect, scrape, or harvest data or contact information without consent; upload viruses or malicious code; probe, scan, hack, overload, disrupt, or circumvent the Service or its security; reverse-engineer, decompile, or copy the Service; or use the Service in any way that violates any law or these Terms. You agree to treat other members with respect.
Content Moderation and Enforcement
By using StreetLink you agree there is no tolerance for objectionable content or abusive users. You can flag or report content and block other users within the app. We review reports and will act on objectionable content and remove offending users, typically within 24 hours of becoming aware. We may, at our sole discretion and without prior notice, remove or restrict content, limit or disable features, and warn, suspend, or terminate accounts to protect the community, comply with law, or enforce these Terms. We are not obligated to monitor User Content but may do so. We are not responsible for User Content, which does not reflect our views.
Copyright and DMCA Policy
We respect intellectual-property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, send a written notice to team@maxwellcollectiveco.com including: your physical or electronic signature; identification of the copyrighted work; identification of the allegedly infringing material and its location; your contact information; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and you are authorized to act. We will remove infringing material and, in appropriate circumstances, terminate repeat infringers’ accounts. Submitting a false notice may result in liability.
Messaging and Voice
Direct messages, community chats, and walkie-talkie voice are for personal, lawful communication between users. Do not use them to harass, threaten, spam, defraud, or share unlawful content. Voice in a crew drive is transmitted live to that drive’s participants; do not assume any communication is private from the people you communicate with. We may access, preserve, or disclose communications where required by law, to enforce these Terms, or to protect users and the public.
Marketplace
The Marketplace lets users list and discover vehicles, parts, and gear. StreetLink is not a party to, and does not broker, guarantee, inspect, appraise, escrow, insure, or otherwise participate in, any transaction between users. We do not verify listings, users, ownership, title, condition, authenticity, legality, pricing, or the safety of any item or in-person meeting. All transactions and communications are solely between the buyer and seller, at their own risk. You are responsible for complying with all laws relating to your listings and sales (including titling, emissions, safety, and consumer-protection laws). Meet in safe, public places; verify items, title, and identity independently; and use caution. StreetLink is not responsible or liable for any listing, transaction, payment, dispute, item, or in-person interaction.
Subscriptions, Boosts, and Payments
StreetLink offers optional paid subscriptions (Plus and Ultimate) and one-time purchases (Boosts) through Apple’s in-app purchase system. Prices and included features are shown at the point of purchase. Subscriptions are billed in advance and renew automatically for the same term and price unless you cancel at least 24 hours before the current period ends. Payment is charged to your Apple ID at confirmation of purchase; manage or cancel your subscription in your Apple ID settings. Except where required by law or Apple’s policies, all purchases are final and non-refundable, and StreetLink does not process refunds—refund requests are handled by Apple. We may change prices, plans, and features on a going-forward basis, with notice where required. Your purchase is also subject to Apple’s applicable terms.
Third-Party Services
The Service relies on and may link to third-party services, including Apple, mapping and location providers, and our infrastructure providers. Your use of those services is governed by their terms and privacy policies. We are not responsible for third-party services, their availability, or their content, and we disclaim liability arising from them.
Feedback
If you send us ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without obligation or compensation to you.
Intellectual Property
StreetLink and Maxwell Collective Co, and their names, logos, designs, graphics, and software, are owned by us and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose, subject to these Terms. You may not copy, modify, distribute, sell, lease, sublicense, reverse-engineer, or create derivative works of any part of the Service except as expressly permitted.
Changes to the Service
We are continuously developing the Service and may add, change, suspend, or discontinue features, content, or availability at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service or any feature.
Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DATA (INCLUDING LOCATION, SPEED, ROUTE, OR ETA) WILL BE ACCURATE OR RELIABLE, OR THAT USER CONTENT, LISTINGS, OR OTHER USERS ARE TRUSTWORTHY, SAFE, OR LAWFUL. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME MAY NOT APPLY TO YOU.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE RELEASED PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO THE SERVICE, YOUR USE OF OR INABILITY TO USE IT, YOUR DRIVING OR RIDING, OR ANY INTERACTION OR TRANSACTION WITH OTHER USERS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR FIFTY U.S. DOLLARS ($50). THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, demands, damages, losses, liabilities, judgments, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Service, your User Content, your driving, riding, or in-person interactions, your marketplace activity, your violation of these Terms, or your violation of any law or any third-party right.
Dispute Resolution; Binding Arbitration; Class Waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR RIGHTS. You and StreetLink agree to first try to resolve any dispute informally by contacting team@maxwellcollectiveco.com. If we cannot resolve it within 30 days, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, rather than in court, except that either party may bring a claim in small-claims court or seek injunctive relief for intellectual-property or misuse claims. The arbitration will take place in Tennessee or your county of residence, and the arbitrator’s decision is final and binding. YOU AND STREETLINK AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION, AND YOU WAIVE ANY RIGHT TO A JURY TRIAL. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms; opting out will not affect any other part of these Terms. If any part of this section is found unenforceable, the remainder will still apply, except that if the class-action waiver is found unenforceable, this arbitration section will be void.
Governing Law and Venue
These Terms and any dispute are governed by the laws of the State of Tennessee and applicable U.S. federal law, without regard to conflict-of-laws principles. Subject to the arbitration section, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Tennessee for any dispute not subject to arbitration.
Termination
You may stop using the Service and delete your account at any time in the app. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms or to protect the Service or its users. Upon termination, your right to use the Service ends. Provisions that by their nature should survive—including content licenses already granted, disclaimers, releases, limitations of liability, indemnification, and dispute resolution—will survive termination.
Force Majeure
We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, outages, network or device failures, third-party service failures, labor disputes, or governmental actions.
General
These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and StreetLink regarding the Service and supersede prior agreements. If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely, including to an affiliate or in connection with a merger, acquisition, or sale of assets. You consent to receive communications and notices from us electronically, including in-app and by email, and agree they satisfy any legal requirement that a communication be in writing.
